Which landlords are affected by LHA?
LHA only affects certain Landlords who enter into a private tenancy agreement with a person who is entitled to Housing Benefit.
LHA does not affect:
- Registered social landlords, such as housing associations
- Protected cases, such as supported housing provided by certain local authorities, social landlords, charities and voluntary organisations
- Tenancies which are excluded from current rent restrictions
- Tenancies in caravans, houseboats and hostels
How does LHA affect landlords?
The only change for most landlords is that LHA will be paid direct to the tenant. Tenants will be responsible for paying their rent to the landlord.
However, there will be protection for claimants who are vulnerable or at risk of rent arrears. For tenants who are unable to manage their affairs or there is a risk that they may not pay their rent, payment may be made direct to the landlord where we believe they are vulnerable or at risk. Also we may pay HB to a landlord if a tenant has rent arrears of 8 weeks or more. This option will continue to be available in LHA cases.
